OVERVIEW
Welcome to PaganEDC.
The terms “we”, “us” and “our” refer to MB Pagana, operating under the PaganEDC brand.
These Terms of Service (“Terms”) govern your access to and use of the PaganEDC online store, website, products, content and related services (collectively, the “Services”).
Our online store is hosted by Shopify, which provides the e-commerce platform that enables us to offer our products and Services to you.
By accessing our website, placing an order or otherwise using the Services, you agree to these Terms and to our Privacy Policy, Return & Refund Policy and other policies referenced on our website.
Nothing in these Terms is intended to exclude, restrict or limit any mandatory consumer rights available to you under applicable law.
If you do not agree with these Terms, you should not use the Services.
SECTION 1 – ACCESS AND ACCOUNT
You may browse our website without creating an account.
If you create an account or provide information when placing an order, you must provide information that is accurate, current and complete.
You are responsible for maintaining the confidentiality of your account credentials and for activity carried out through your account.
If you are under the age of majority in your country of residence, you may use the Services only with the involvement and consent of a parent or legal guardian where required by applicable law.
Additional age requirements apply to restricted products such as knives, as described in Section 2.
We reserve the right to suspend or restrict access to an account where we reasonably believe it is being used fraudulently, unlawfully or in violation of these Terms.
SECTION 2 – OUR PRODUCTS AND LEGAL RESTRICTIONS
We make reasonable efforts to display and describe our products accurately.
Product colours may appear slightly different depending on lighting, photography, production batches, screen settings and the device used to view the product.
Product dimensions may vary slightly where products are manufactured from flexible materials or produced in separate manufacturing batches.
Product descriptions, specifications, prices and availability may be updated from time to time.
We may discontinue products or limit quantities available for purchase.
Some products sold through PaganEDC, including knives, may be subject to age restrictions, import restrictions, possession restrictions or other legal requirements depending on the destination country or region.
By purchasing a restricted product, you confirm that:
you meet any applicable minimum legal age requirements;
you are legally permitted to purchase, receive and possess the product in your jurisdiction; and
the import, delivery and possession of the product is permitted by applicable law.
We may request reasonable age or eligibility verification before dispatching a restricted product.
We reserve the right to refuse or cancel an order where we reasonably believe that supplying or delivering the product would violate applicable law, carrier restrictions or other legal requirements.
If we cancel an order for this reason before shipment, any amount paid for the cancelled product will be refunded.
Nothing in this Section limits our legal obligations concerning product safety, conformity or consumer protection.
SECTION 3 – ORDERS AND CONTRACT FORMATION
When you place an order through our store, you are making an offer to purchase the products listed in your order.
After your order is submitted, you will normally receive an electronic confirmation.
We reserve the right to reject or cancel an order before dispatch where there is a legitimate reason, including:
product unavailability;
an obvious pricing or product information error;
suspected fraud or unauthorised payment;
inability to deliver to the selected destination;
legal or regulatory restrictions; or
other circumstances that reasonably prevent us from fulfilling the order.
If we cancel an order after payment has been received, we will refund the amount paid for the cancelled items.
Please review your order details carefully before completing your purchase.
If you need to modify or cancel an order, contact us as soon as possible. We cannot guarantee that an order can be changed or cancelled once processing or dispatch has begun.
Nothing in this Section affects any statutory cancellation or withdrawal rights available to consumers under applicable law.
Returns and withdrawals are governed by our Return & Refund Policy and mandatory consumer law.
SECTION 4 – PRICES, TAXES AND PAYMENT
Prices displayed in our online store include applicable taxes where required by law and as indicated on the website or during checkout.
For consumers in the European Union, prices are presented in accordance with applicable rules concerning the display of prices and taxes.
Shipping costs are shown separately before the customer completes the purchase unless shipping is offered free of charge.
For orders delivered outside the European Union, customs duties, import taxes, brokerage fees or similar charges may apply depending on the destination country.
Unless expressly stated otherwise during checkout, such import-related charges are not included in the product or shipping price and may be collected by the relevant authorities or carrier.
The applicable product price is the price displayed when the order is submitted, subject to any valid discount or promotion.
Promotions, discount codes and automatic discounts may be subject to separate terms, eligibility rules, minimum purchase requirements or combination restrictions.
We reserve the right to correct genuine pricing or technical errors. Where an obvious pricing error affects an order that has not yet been dispatched, we may contact you to confirm the correct price or cancel the affected item and issue a refund.
You agree to provide valid and accurate billing and payment information.
Payments are processed through the payment methods made available during checkout.
SECTION 5 – SHIPPING AND DELIVERY
We deliver to the countries and regions made available during checkout.
Available delivery methods, shipping charges and estimated delivery periods may vary depending on the destination, order contents and carrier.
Estimated delivery dates are provided for guidance and may be affected by carrier operations, customs processing, public holidays, weather, force majeure events or other circumstances outside our reasonable control.
Where a specific delivery period has been agreed, we will make reasonable efforts to deliver within that period.
Where applicable consumer law requires delivery within a specific maximum period and no different delivery period has been agreed, that statutory period will apply.
For EU consumer contracts, where no other delivery period has been agreed, goods are generally required to be delivered without undue delay and no later than 30 days after conclusion of the contract.
For consumer orders, responsibility for the goods remains with PaganEDC until the goods are physically received by you or by a third party designated by you, except where you independently arrange a carrier that was not offered by us.
You are responsible for providing a correct and complete delivery address.
If an order is returned because an incorrect or incomplete delivery address was provided, additional delivery charges may apply where permitted by law.
International orders may be subject to customs procedures and import requirements in the destination country.
SECTION 6 – INTELLECTUAL PROPERTY
The content of the PaganEDC website, including trademarks, logos, product designs, original artwork, photographs, graphics, text, video, audio, website layout and other materials, is owned by or licensed to PaganEDC unless otherwise stated.
Such materials are protected by applicable Lithuanian, European Union and international intellectual property laws.
You may access and use the website for personal and lawful purposes.
You may not reproduce, copy, distribute, sell, license, modify, publish or commercially exploit PaganEDC content or intellectual property without our prior written permission, except where such use is permitted by applicable law.
The PaganEDC name, logo and associated branding may not be used in a manner that suggests affiliation, sponsorship or endorsement without our written permission.
Third-party trademarks, designs and other intellectual property appearing on the website remain the property of their respective owners where applicable.
SECTION 7 – OPTIONAL THIRD-PARTY TOOLS
We may provide access to features, tools or services supplied by third parties.
These third-party tools may be provided subject to the terms and policies of their respective providers.
We do not control third-party tools and cannot guarantee their continued availability or functionality.
Your use of third-party tools is subject to any applicable third-party terms.
Nothing in this Section excludes liability where such liability cannot legally be excluded.
SECTION 8 – THIRD-PARTY LINKS AND SERVICES
Our website may contain links to or integrations with third-party websites, services or platforms.
We are not responsible for the content, accuracy, security, availability or privacy practices of independent third-party websites.
If you access a third-party website, your use of that website is governed by the third party’s terms and privacy policies.
Any concerns relating specifically to products or services supplied independently by third parties should be addressed to the relevant third party.
This Section does not affect any responsibility PaganEDC may have under mandatory consumer law.
SECTION 9 – RELATIONSHIP WITH SHOPIFY
Our online store is hosted by Shopify.
Shopify provides the technical e-commerce platform used to operate the store, but products purchased from PaganEDC are sold by MB Pagana.
Your sales contract is with MB Pagana unless expressly stated otherwise.
Shopify may process certain information in connection with operating the platform in accordance with its own applicable privacy terms.

SECTION 10 – PRIVACY
Personal information collected through the Services is processed in accordance with our Privacy Policy and applicable data protection legislation.
Because our store is hosted by Shopify and may use third-party payment, analytics, advertising, email, shipping and other service providers, information may be processed by those service providers where necessary to operate the Services.
Our Privacy Policy contains further information about the categories of data collected, purposes of processing, legal bases where applicable, data sharing and your rights.
SECTION 11 – REVIEWS, FEEDBACK AND USER CONTENT
If you submit a product review, photograph, suggestion, comment or other content to PaganEDC, you confirm that you have the right to submit that content.
You grant PaganEDC a non-exclusive, worldwide, royalty-free licence to reproduce, display and use submitted content where reasonably necessary to operate, improve or promote our Services and products.
This licence does not transfer ownership of your content to PaganEDC.
You must not submit content that is unlawful, misleading, defamatory, abusive, infringing or otherwise violates the rights of another person.
We may moderate or remove user-generated content where reasonably necessary to comply with law, protect other users or enforce these Terms.
Reviews must reflect genuine experiences and must not contain deliberately false or misleading statements.
SECTION 12 – ERRORS, INACCURACIES AND OMISSIONS
Information on our website may occasionally contain typographical errors, technical inaccuracies or omissions relating to product descriptions, availability, prices, promotions, shipping costs or estimated delivery times.
We may correct such information when identified.
Where an error materially affects an order that has already been placed, we will take reasonable steps to contact you and resolve the issue in accordance with applicable law.
Nothing in this Section limits any statutory rights you may have where goods do not conform to their description or contract.
SECTION 13 – PROHIBITED USES
You may use the Services only for lawful purposes.
You must not use the Services:
to violate applicable law or regulation;
to infringe intellectual property, privacy or other legal rights;
to submit fraudulent, false or misleading information;
to impersonate another person or entity;
to distribute malware, malicious code or other harmful material;
to attempt unauthorised access to the website, accounts or systems;
to scrape, crawl or extract website content in a manner that violates applicable law or our rights;
to interfere with the security or operation of the Services;
to use the Services for harassment, abuse, threats or unlawful discrimination; or
to carry out fraudulent payment activity or other unlawful transactions.
We may restrict or terminate access where reasonably necessary in response to prohibited or unlawful activity.
SECTION 14 – SUSPENSION AND TERMINATION
We may suspend or terminate access to an account or to parts of the Services where there is a reasonable basis to believe that these Terms have been materially violated or the Services are being used unlawfully or fraudulently.
Termination of website access does not affect contractual obligations, payments, refunds, statutory consumer rights or other rights and obligations that arose before termination.
Provisions which by their nature are intended to continue after termination, including intellectual property, liability, governing law and dispute resolution provisions, will continue to apply.
SECTION 15 – CONSUMER RIGHTS, RETURNS AND LEGAL GUARANTEE
Nothing in these Terms removes or reduces mandatory consumer rights.
Consumers purchasing online in the European Union generally have the statutory right to withdraw from a distance contract within 14 days after receiving the goods without giving a reason, subject to applicable legal exceptions.
Certain goods, including products made to a customer’s specifications or clearly personalised products, may be excluded from the statutory right of withdrawal where permitted by law.
In addition to statutory rights, PaganEDC may offer a voluntary return period as described in our Return & Refund Policy.
The voluntary return policy does not replace or restrict statutory rights.
Consumers in the European Union benefit from a minimum two-year legal guarantee of conformity for consumer goods.
If a product is defective, does not conform to its description or does not function as reasonably expected, consumers may be entitled to remedies such as repair, replacement, price reduction or refund in accordance with applicable law.
Any voluntary commercial warranty or guarantee offered by PaganEDC or a manufacturer is additional to and does not replace mandatory legal guarantee rights.

SECTION 16 – LIMITATION OF LIABILITY
Nothing in these Terms excludes, restricts or limits any rights or remedies that cannot be excluded, restricted or limited under applicable law, including mandatory consumer protection rights.
PaganEDC is responsible for providing products in accordance with the contract and for any liability that applies under mandatory consumer protection, product safety and product liability laws.
To the fullest extent permitted by applicable law, PaganEDC will not be liable for losses or damages that:
were not reasonably foreseeable when the contract was entered into;
result from improper, unlawful or unintended use of a product;
result from failure to follow product instructions, warnings or applicable safety requirements;
arise from information supplied incorrectly or incompletely by the customer;
result from events outside our reasonable control, except where applicable law provides otherwise; or
relate solely to business or commercial losses where the customer purchased the product as a consumer for personal use.
Nothing in these Terms limits or excludes our liability for:
death or personal injury caused by our negligence where such liability cannot legally be excluded;
fraud or fraudulent misrepresentation;
wilful misconduct or gross negligence where applicable;
defective, unsafe or non-conforming products where mandatory law provides rights or remedies;
liability arising under applicable product liability laws; or
any other liability that cannot lawfully be excluded or limited.
Customers are responsible for using products safely, appropriately and in accordance with applicable law.
This is particularly relevant to knives and other products that may be subject to local age, possession, carrying or use restrictions.
This responsibility does not affect statutory rights relating to defective, unsafe or non-conforming products.
Where third-party services are used as part of the Services, including payment processors, carriers or technical service providers, PaganEDC is not responsible for acts or omissions of those third parties beyond the extent required by applicable law.
Any limitation of liability contained in these Terms applies only to the extent permitted by applicable law.
SECTION 17 – INDEMNIFICATION
To the extent permitted by applicable law, you may be responsible for losses reasonably incurred by PaganEDC where those losses directly result from your deliberate unlawful use of the Services, your infringement of another person’s intellectual property rights or your fraudulent activity.
This Section does not impose liability on consumers for matters for which they cannot legally be held responsible and does not limit mandatory consumer rights.
Nothing in this Section requires a consumer to indemnify PaganEDC for PaganEDC’s own negligence, breach of contract, unlawful conduct or failure to comply with mandatory legal obligations.
SECTION 18 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will apply only to the maximum extent permitted by law.
Where possible, the invalid or unenforceable part will be separated from the remaining Terms.
The validity and enforceability of the remaining provisions will not be affected.
SECTION 19 – WAIVER AND ENTIRE AGREEMENT
If we do not immediately exercise a right available under these Terms, this does not mean that we waive that right.
These Terms, together with our Privacy Policy, Return & Refund Policy, Shipping Policy and any other policies expressly incorporated into the transaction, form the agreement governing use of the Services and purchases made through the store.
Nothing in this Section excludes information or rights that form part of the contract under mandatory consumer law.
Any ambiguity in standard consumer contract terms will be interpreted in accordance with applicable consumer protection law.
SECTION 20 – ASSIGNMENT
You may not transfer contractual rights or obligations to another person where such transfer would materially affect our rights or obligations, except where permitted by law or agreed with us.
We may transfer or assign rights or obligations relating to the operation of the business where necessary for a legitimate business purpose, provided that such transfer does not reduce mandatory consumer rights or materially disadvantage the customer.
Nothing in this Section restricts any assignment or transfer permitted by mandatory law.
SECTION 21 – GOVERNING LAW AND CONSUMER PROTECTION
These Terms and contracts concluded through the PaganEDC online store are governed by the laws of the Republic of Lithuania.
If you are a consumer residing in another country, this choice of law does not deprive you of mandatory consumer protection rights granted to you under laws that apply to you and cannot be excluded by agreement.
Any court proceedings shall be brought before the courts having jurisdiction under applicable law.
Nothing in these Terms restricts a consumer’s statutory right to bring proceedings in a court that has jurisdiction under applicable consumer protection rules.
SECTION 22 – COMPLAINTS AND DISPUTE RESOLUTION
If you have a complaint about a product, order or Service, please contact PaganEDC first at info@paganedc.com.
Please describe the issue and provide relevant order information and supporting documentation where appropriate.
We will review consumer complaints free of charge.
Where Lithuanian consumer law applies, we will provide a reasoned written response to a consumer complaint within 14 calendar days of receiving it.
If a consumer dispute cannot be resolved directly, consumers may have the right to submit the dispute for out-of-court resolution to the State Consumer Rights Protection Authority of Lithuania (Valstybinė vartotojų teisių apsaugos tarnyba – VVTAT), including through the Consumer Rights Information System (VTIS).
Consumers involved in cross-border disputes within the European Union may also seek assistance from the European Consumer Centres Network (ECC-Net).
Using an alternative dispute resolution procedure does not remove any right to bring a claim before a competent court.
SECTION 23 – CHANGES TO THESE TERMS
We may update these Terms from time to time to reflect changes to our Services, business operations, technology or legal requirements.
The current version of the Terms will be published on our website together with the date of the latest update.
Changes will not retroactively remove or reduce rights that already arose under an existing contract unless permitted by applicable law.
Where applicable law requires notice of material changes, such notice will be provided.
